When we lose something, we gain something BETTER.

Earlier this year, I lost something that is very important in my life. I lost having a COMPLETE family of my own. It hurt so bad. It really did. I did not see it coming. I never saw it coming. But i knew it was inevitable. 

Currently, I have undergone a lot of changes in my life. Some were attributable to my recent experiences. As the saying goes, when we lose something in our life, SOMETHING BETTER comes along. Perhaps this is WHY I am in law school now. 

I have always looked forward to the day that I go back to school. I graduated when I was only 19 years old and I worked since then. Thinking about those times, I realized that I should have continued my studies first before entering the professional world. But then, life comes as it is. It is a product of my decisions and I am not regretful of the things that have shaped me into who I am today. 

So, I am now in law school. And my goal is to survive this until I acquire my license.  

Whenever I ponder on my career plan after finishing law, I always think about my passion for service and charity. However, my priority goal is of course to give my daughter a great future which is what is really ahead of her and what she deserves.

I have also been very interested in industrial relations; therefore, I would like to also help or reach out to organizations and individuals in addressing their employment concerns and provide them the services that I ought to practice. My past work experiences have shaped my interest in human resources and I have been exposed to or have seen workplace blunders that I would really love to correct. 

With regard to my professors, I expect them to be harsh at times, considerate maybe, but I really hope to gain more wisdom and knowledge through them. They will be my tickets to surviving this journey and I am hopeful that I will be able to cope with their standards and expectations.   

As I picture myself as a lawyer, I want to see a woman who is conscientious, patient, diligent and firm. I know I need to improve on my patience and to be more mature in dealing with problems that I continue to face day by day. I am positive that I will be a conscientious lawyer who will always uphold the truth and will fight for my clients.

Life has given me a lot of struggles and what I am facing now will surely make me a better person tomorrow. With these struggles, I know that I can do anything and that I will be able to survive law school. 

I want be a good example to the youth. I want to contribute to the intellectual life of my community by standing firm with my decisions and beliefs. I will apply the laws the right way and I want that the truth always prevails. I will not conform to the wrong system. I will challenge myself to be a truthful lawyer always and I will not let anyone step on my principles. 

Ultimately, I want to improve other people's lives through this profession and contribute to the betterment of the organizations I will join in the future. 

So help me God.

ORTIGAS & CO., LIMITED VS. CA, 346 SCRA 748

FACTS:  Petitioner sold a parcel of land, located in Greenhills Subdivision IV, San Juan to EMILIO HERMOSO. WIth the said sale, it was stated in the contract that the said lot shall only be used exclusively for residential purposes, until December 31, 2025. In 1981, the Metropolitan Manila Commission (MMC) enacted an ordinance known as the Comprehensive Zoning Area for the NCR. The ordinance reclassified portions of Ortigas Avenue from Madison to Roosevelt Streets to a commercial area where, apparently, the lot was located.  In 1984, private respondent Ismael Mathay III leased the said lot from Emilio Hermoso and built a single storey building for a car sales company. CONSUNJI VS. CA, GR # 13783, 20 April 2001

FACTS:  Jose Juego, a construction worker of the DM Consunji, Inc., fell 14 floors from the Renaissance Tower on November 2, 1990 and died. His wife, Maria, filed a complaint for damages against the DMCI before the Regional Trial Court (RTC) of Pasig. The DMCI argued, in defense, that Maria Juego already availed of the death benefits from the State Insurance Fund.  The RTC ruled in favor of Maria. The DMCI filed an appeal before the Court of Appeals (CA) but the CA affirmed the decision of the RTC in toto.  In the DMCI's appeal, it contended that upon Maria's claim of the death benefits from the State Insurance Fund, she may no longer prosecute a civil action against the employer citing the Workmen Compensation's Act.  ISSUE:  Whether or not the waiver of Ms. Maria's rights was valid during the time that she claimed the death benefits while she was unaware that in doing so, she is relieved from her right to pursue a civil action against the DMCI....
